Because the air at cloud level isn't cold enough, regardless of the surface cold. 

Case in point, I got home at 1.30am when there was a hard frost on the grass and cars. By 1.45 it was raining hard. It formed an icy slush on the car roof for a time but was falling purely as rain. 

And a few minutes ago it was freezing and still raining.  Hence the report (METAR) from the airport of light freezing rain.

More of the same to come today perhaps without the freezing bit.

After a bright start, it is now rather cloudy and does look rather murky over the hills. No frost observed since the minimum was 2.3 C at midnight last night and then slowly was on the rise for the rest of the night.
